Mediation Fee Schedule
TIME AND DURATION
A half-day mediation is typically 9 am - 1 pm or 1 pm - 5 pm.
A full-day mediation typically begins at 9:00 a.m., includes a working lunch and continues until completed. While most sessions conclude by approximately 5:00 p.m., a session may extend into the evening. If your preferred start time differs, we will do our best to accommodate you.
Weekends are available for mediation if requested by the parties or required by scheduling limitations. If the mediation session occurs on a weekend, a supplemental charge of $200 – $400 will be allocated amongst the parties for support staff overtime and building HVAC costs.
A few cases require more than one mediation session. If needed, subsequent sessions are usually scheduled by mutual consent at the completion of the mediation day. If the parties initially request that more than one successive mediation day be scheduled, then the full fee for all scheduled sessions is due and earned upon commencement of the first day of mediation.

Multi-Party Litigation

Special Judge Appointments
Appointment as a "Special Judge" pursuant to chapter 151 of the Texas Civil Practices and Remedies Code 500.00 per hour, 2-hour minimum, plus travel-related costs.
Justice delayed is justice denied. Over the past few years, the COVID pandemic has played havoc on our courts. Many courts are backlogged with cases and final hearings in contested matters being set out in mid to late 2024. The judges at Momentum Mediations are all qualified to serve as "Special Appointed Judges" under chapter 151 of the Texas Civil Practice and Remedies Code.
Title 7 Alternate Methods of Dispute Resolution provides that if all parties to the litigation agree in a civil or family law matter cases may be referred to a special judge chosen by the parties to hear and adjudicate issues involving both questions of fact and of law. Upon motion made by all parties to the case, the motion must set out that the parties are requesting the referral, that they waive a jury, sets out the issues to be decided by the special judge and the specific judge that will hear the case, and sets out the time and the place of the hearing. Trials under chapter 151 are conducted in accordance with the rules of civil procedure, the ruling of the court is final and enforceable and is appealable consistent with the Texas Rules of Appellate procedure. Pre-suit mediations will be conducted under the same fee arrangements.
The usual mediation fee is stated on a “per party” basis. The number of parties is determined by counting all parties represented by the same counsel as one party. Additionally, if one party is represented by multiple attorneys, that party is still considered as one party. Related parties, even with aligned interests, are considered as separate parties if they have separate counsel.
The mediation fee shall be deemed fully earned at the commencement of the initial mediation session. Payment of the mediation fee is due within 10 days of the confirmation of the mediation, but not later than the commencement of the mediation session. All mediation fee payments shall be in the form of cash, cashiers check, insurance company check, corporate check, or check drawn on the bank account of (or payment guaranteed by) a law firm and payable to Momentum Mediation.
If requested by the participants, we will travel out-of-town to conduct mediation sessions at a mutually convenient location. If the mediation is in a county not contiguous with Hood or Tarrant County there is an additional charge of $250.00 per party. In the unusual event that travel expenses other than mileage are required, the costs are to be divided equally among the parties. If it is necessary to spend an additional day traveling to or from a mediation location, the mediation session will be billed as a multiple session for the total number of days involved in the travel and conducting the mediation session.
At the present time, we are not instituting a rescheduling or cancellation fee; however, rescheduling is only permitted with the agreement of all parties and the court. We will continue this policy of no rescheduling or cancellation fee as long as this policy is not abused.
Each party’s attorneys shall be responsible for the timely payment of all fees specified herein. The mediator reserves the right to refuse to commence the mediation session if all fees have not been tendered in acceptable form.
The daily fee includes:
- Scheduling and administering the session;
- Any pre-mediation attorney conferences;
- Preparing for and conducting the mediation session;
- Conducting the post-session telephone facilitation and correspondence as needed;
- Refreshments for all present; and
- Lunch for all present (full day only).
